Terms & Conditions

The accepted estimate, the initial deposit, and these Terms & Conditions form a binding legal agreement between Solteq Florida, LLC and its customer for each transaction.

Contract

The funding of the initial deposit represents the customer’s acceptance of the estimate and the Terms & Conditions as presented here. Together, the accepted estimate, the initial deposit, and these Terms & Conditions constitute the contract between Solteq Florida and its customer.

Estimates, Orders, Sales & Payments

Estimates are good for 15 days, or the date shown on the estimate, whichever is earlier. Solteq Florida can only honor a customer estimate to the same extent that manufacturer honors its quote to Solteq Florida for the same materials.

A 50% non-refundable deposit is required to initiate the order. The 50% balance is required to ship the materials from Germany to its destination. Shipment cannot be expedited or released without full invoice payment.

All sales are final with the acceptance of the contract and the initial deposit. No refunds, exchanges, or trades are permitted. Material quantities may not be reduced once the order is placed, and the deposit is funded. As a result, the customer should diligently review designs and orders to ensure the appropriate quantities of materials are being requested when the order is placed. The customer is responsible for ensuring quantities are accurate and takes full responsibility for the materials order as reflected in their invoice.

Additional materials may be added to the order prior to shipment from Germany but are not guaranteed to be available for the same shipment.  

Should the customer require additional materials at any point, those materials may be subject to standard manufacturing and logistics timelines from Germany or other point of origin to the USA or other destination. If the customer requests expedition, the customer can pay to air freight the materials to their location or job site at their own cost.

Certification & Delivery

Unless otherwise specified, all sales are FOB Solteq Florida’s headquarters in Vero Beach. All freight to the customer’s warehouse or job site is at the customer’s expense. At the customer’s request, Solteq Florida may assistin scheduling delivery to customer’s job site. However, Solteq Florida assumes no liability associated with the selection of the carrier, the shipment of materials from its facility, or their condition upon arrival. The customer will hold Solteq Florida harmless to any damage incurred after leaving its facility.

The customer will inspect the materials upon receipt, certify their condition, and report to Solteq USA and Solteq Florida any material defects immediately and according to the warranty procedures provided by Solteq USA and Solteq GmbH (the manufacturer). If the customer is not present upon pick-up at Solteq Florida’s headquarters, the customer authorizes Solteq Florida and its shipping contractor to inspect materials and certify their condition on the customer’s behalf prior to loading the order with a third-party carrier.

Tile delivery timelines vary based on manufacturer backlog. Solteq Florida makes no guarantees of delivery date. Instead, Solteq Florida provides its customers with a target delivery window, which may be affected by supplier backlogs, manufacturer backlogs, labor and union strikes, logistics issues, force majeure, or other forces out of Solteq Florida’s control. Solteq Florida will make reasonable attempts to accelerate the delivery timeline by placing appropriate pressure on Solteq USA and Solteq GmbH in the interest of its customer’s business and installation timeline. Solteq Florida recognizes that delays may impact the operations, reputation, cash flows, and other aspects of its customer’s business, but assumes no liability for the impact of these disruptions or delays. Global supply chains remain turbulent following the global COVID pandemic, and certain suppliers and logistics carriers are still adjusting, which can result in unanticipated delays of up to 12 months.

Taxes, Duties, & Fees

Invoices should reflect relevant jurisdictional sales tax, value-added tax, excise tax, and customs duties. However, in the event such taxes, duties, or fees are missing from the invoice but are due, Solteq Florida reserves the right to pass this tax through to its customer on the same or a new invoice, and the customer will be responsible for paying that invoice due on receipt.

Liability & Warranty

Solteq is a distributor, and its business is limited to trading wholesale products for the solar roof industry.

Solteq is not a licensed roofer, licensed electrician, or licensed solar installer and makes no claims of licensing, training, or expertise regarding these trades or the future performance of Solteq solar roof tile system. Any information provided to the customer, the building owner, or any installation partner relating to system sizing, placement, string design, and hardware and software selection is provided solely to support the customer and installation parties in their delivery of a quote, service, and installation of the Solteq products.

Solteq products may not be approved in all jurisdictions. The customer is responsible for validating that the Solteq products ordered meet building code requirements for the planned installation. To the extent the customer is also the installer, the customer is responsible for possessing all necessary licensing and insurance requirements as required in that respective jurisdiction.

Solteq Florida does not warranty the products it buys and sells from other manufacturers and wholesalers, including Solteq USA and Solteq GmbH. It makes no representations or warranties on their performance, durability, or maintenance. Rather, it expressly points to the specific warranty language provided by each product manufacturer. The customer is responsible for filing and maintaining any and all warranty paperwork. Solteq Florida may assist the customer in registering warranties, but assumes no liability in the event these registrations are filed with errors or inaccuracies that negatively affect or void the warranty.

At the building owner’s request and at Solteq Florida’s sole judgment and discretion, Solteq Florida may help in navigating a warranty claim with Solteq USA, Solteq GmbH, the general contractor, the architect, the roofer, the solar installer, the electrician, and any other parties involved in the design and installation of the Solteq solar tile roof system to troubleshoot an issue or resolve a question. Solteq Florida assumes no warranty liability by virtue of its participation in these claims processes. Solteq Florida recommends that customers should generally turn to their General Contractor or their primary installation contractor when seeking to make a warranty claim.

Solteq Florida does not provide training or guidance to roofers, solar installers, or electricians on the appropriate installation methods. Such training, Dealer Certification, and Installer Certification are provided directly by Solteq USA and their licensed trainers. Solteq Florida assumes no responsibility for improper installations performed by its cuatomers, their customers, installers, or building owners. Warning

Solar products, materials, and systems, including solar tiles, are fundamentally electrical systems and therefore should be handled with great caution and care. If manufacturer recommendations are not followed by installers or building owners and managers, serious injury or death can occur. Solteq Florida assume no liability for the risks inherent with installing, operating, and maintaining a solar-electrical system.
